Representation of national residential builder in various matters, including drafting form contracts and defense of home warranty claims.

 

Defense of highway contractor in bid protest against award of contract to client.  Bid protest denied at administrative level.

 

Counsel to Commonwealth of Virginia Design-Build/Construction Management Review Board

 

Defense of condominium Association in jury trial against unit owner alleging destruction of the unit from Association's negligent failure to repair and maintain common elements.  Defense verdict for Association.

 

Defense of freight shipping and trucking company in two separate OSHA suits involving release of, and exposure to, toxic chemicals.  One exposure resulted in the death of an employee.  Two separate trials resulting in two defense verdicts.

 

Defense of the closely-held business and its owner against a suit seeking ownership interest in the closely-held business.  Defense verdict for closely-held business and its owner.  Verdict sustained on appeal.

 

Defense of national residential builder in arbitration under rules of American Arbitration Association against claim for return of deposit brought by buyer who failed to close.  Defense award.  Builder retained five-figure deposit as liquidated damages.

 

Defense of small business against the claim of sex discrimination.  Defense verdict.

 

Defense of candidate for public office in suit seeking to overturn candidate's nomination.  Defense verdict sustaining validity of nomination.

 

Representation of an international insurance company and an international shipping company in subrogation action against contractors and design professionals for negligent construction of a roof system and breach of design services contracts.  Settled.

 

Defense of commercial general contractor in largest fire in Richmond since 1865.  Successful opposition to arbitration demands in unfavorable forums.  Settlement of claims against contractor within limits of liability insurance policies.

 

Representation of an international insurance company in subrogation action against a roof systems manufacturer for defective roof products and installation.  Jury verdict for $401,000 in favor of insurance company.

 

Defense of hot tub installer in fire case involving destruction of expensive residence.  Arbitration award in favor of installer.

 

Defense of trucking company against claim for unemployment compensation by fired employee.  Compensation claim denied.

 

Representation of large insurance company against developer based on developer's failure to provide prompt notice of damages to another property owner from developer's defective water detention structures.  Defense verdict in favor of insurance company following bench trial.

Assisted multinational insurance company in enforcement of judgment for insurance fraud obtained in the United States.  Consulted with co-counsel in the City of Kiel, Germany in enforcement and collection of six-figure fraud judgment in Germany.  Provided written explanations of American law for use in the trial court (Landgerichte) and German appellant court (Schleswig-Holsteinisches Oberlandesgericht).

                                                                                         

Lead counsel in representation of national insurance company, commercial condominium Association and commercial general contractor in suit against subcontractor for negligently caused damage to medical condominium.  Four-day jury trial resulting in verdict of $1.6 million.  Verdict sustained on appeal to the Virginia Supreme Court.
